ENGLISH LANGUAGE SKILLS REQUIRED FOR PARTICIPATION.

Contest may only be entered in or from the United States of America and eligible jurisdictions that do not prohibit the operation of the Contest (the “Eligible Jurisdictions”) and entries originating from any other jurisdiction are not eligible for entry. Contest void in Quebec, outside of the Eligible Jurisdictions and if prohibited by law. All judging and winner selection shall take place in the United States of America.
You will be asked to provide your name and specific information such as phone number, email address, nationality and date of birth and will be asked to create a Pilot user name (“User Name”) and password in connection with creating an account. You are responsible for ensuring that your User Name is not offensive, discriminatory or inappropriate. Notwithstanding the foregoing, Sponsor may reject a proposed User Name on the basis that it is offensive or inappropriate, or for any other reason whatsoever.
Provided that you meet the Eligibility requirements set forth in these Official Rules, including without limitation Section 3 below, you must race in one or more of the following twelve (12) Online Qualification Tournaments hosted on the DRL Simulator and live streamed via the Twitter & YouTube (each, a “Race”). Each Race is a test of skill on the DRL Simulator and except with respect to the Participation and Viewership Awards set forth in Section 6 below, chance does not play a part in the determination of the winner. Each Race will operate on a time trial qualifier format for the first thirty (30) minutes.
Sponsor shall maintain overall and regional leaderboards (each, a “Leaderboard”) comprised of the eligible entrants who have the highest game scores (“Game Scores”). All Game Scores on the Leaderboard are subject to Sponsor’s verification. As part of the verification process, Sponsor may require that an entrant sign and return within the time frame designated by Sponsor a declaration or other documentation attesting to compliance with these Official Rules. Regular DRL Simulator Race settings apply.
The winner of each Race, subject to verification and compliance with these Official Rules (each, a “Finalist”) will be eligible to compete in the Live Online Finals Tournament for the opportunity to enter into a DRL Pilot Agreement with Sponsor as detailed further below. Sponsor’s clock shall be the official time-keeper in all decisions and determinations. The Race dates are as follows:
The verified twelve (12) Finalists will then participate in the Live Online Tournament, currently scheduled for April 2nd, 2020. The Finalists will race in a standard DRL bracket elimination procedure until there is one (1) Grand Prize Winner (subject to verification and compliance with these Official Rules).
Entrants are only eligible to participate in the Contest if they have the following: (i) a suitable Windows or Mac PC; (ii) the DRL Simulator as made publicly available; and (iii) an internet connection. Pilots are responsible for providing their own computer hardware and internet connection. Sponsor recommends a 3 MB/s download and 0.5 MBs upload internet connection.
All entry information shall be collectively referred to herein as the “Submissions” or each as a “Submission.”
By entering, each entrant warrants and represents the following with respect to entrant’s Submission: (a) entrant is the sole and exclusive owner of the Submission and entrant has all appropriate rights, powers and authority to grant Sponsor all licenses to the Submission as set forth herein; (b) the Submission will not infringe on any rights of any third parties; (c) to the extent possible under applicable law, no party can invoke any moral rights in relation to the Submissions that have not been duly waived; (e) the Submission and entrant’s participation does not violate any local, state, provincial, national or foreign law; and (d) the Submission does not contain the confidential information of any third party, and to the extent it contains entrant’s confidential information, such information immediately becomes non-confidential the moment entrant submits the Submission to Sponsor.
Providing a Submission constitutes entrant’s agreement that such Submission and any copyrights or trademarks therein, become the sole property of Sponsor and will not be returned. The Submission will be considered a “work made for hire” as such term is used and defined under applicable law. In the event that a Submission is not considered a “work made for hire,” each entrant hereby assigns and agrees to assign all right, title and interest in and to their Submission including all copyrights therein, throughout the world, in perpetuity, to Sponsor. Accordingly, Sponsor shall have an irrevocable, perpetual (or for the duration of protection of the rights where perpetuity is void), right to use, reproduce, modify, publish, create derivative works from, and display such Submissions in whole or in part, on a worldwide basis, with or without identification of the entrant or any authors of the Submission, in whatever form and in whatever circumstances Sponsor sees fit, and to incorporate it into other works, in any form, media or technology now known or later developed (but for Spanish participants, in any medium known at the time when such rights were granted), for any purpose whatsoever, including for promotional or marketing purposes and consent to Sponsor doing (or omitting to do) any acts in respect of the entry which may otherwise constitute an infringement of the entrant’s moral rights, to the fullest extent permitted by law.
Entrants agree that entering the Contest may affect his/her legal rights, including, but not limited to, each entrant’s ability to obtain patent rights, copyright registration, trade secret protection, or other intellectual property or proprietary rights with respect to the information disclosed in the Submission. Entrants agree that Sponsor has not induced any entrant to enter the Contest, and is not responsible or liable to any entrant for any loss of right suffered by any entrant for entering the Contest.
Entrants must comply with the applicable laws, decrees, regulations and guidelines of their Eligible Jurisdiction, and Sponsor will have no obligation to change or modify any of these Official Rules or take any further action as a result of such laws, decrees, regulations or guidelines of any Eligible Jurisdiction, except as is otherwise provided in these Official Rules.
Players may race in more than one Race provided that if a player wins a Race and becomes a Finalist, they may not participate in another Race. All terms and conditions of Sponsor, YouTube, Twitter and/or any Contest-related website apply. Multiple entrants are not permitted to share the same email account. Any attempt by any entrant to obtain more than the stated number of entries by using multiple/different email accounts, identities, registrations and logins, or any other methods will void that entrant’s entries and that entrant may be disqualified. Use of any automated system to participate is prohibited and will result in disqualification. In the event of a dispute as to any email account, the authorized account holder of the email address used to register on the platform or for the account will be deemed to be the entrant. The “authorized account holder” is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. Each potential winner may be required to show proof of being the authorized account holder.
Receipt of entries will not be acknowledged or returned. Sponsor is not responsible for lost, late, illegible, stolen, incomplete, invalid, unintelligible, postage-due, misdirected, technically corrupted or garbled entries, which will be disqualified, or for problems of any kind whether mechanical, human or electronic. Proof of submission will not be deemed to be proof of receipt by Sponsor. By entering the Contest, entrants fully and unconditionally agree to be bound by these rules, and any and all terms and conditions, rules and agreements used in connection therewith, including but not limited to the DRL Privacy Policy, DRL Terms of Use, the DRL Live Tournament Rules and Terms and Conditions (all DRL policies may be updated from time to time and will be available at thedroneracingleague.com the any video game Platform Terms and Conditions, Terms of Use, Privacy Policies, and Account Rules, Twitter and YouTube Terms of Use, and any other rules and terms of use and conditions of DRL or its third party affiliates, licensees, partners, designees, assignees, including but not limited to Sponsor and Twitter/YouTube and/or any Contest-related website in connection with the Contest, and the decisions of the judges, which will be final and binding in all matters relating to the Contest. Entrants must comply with the applicable laws, decrees, regulations and guidelines of their Eligible Jurisdiction, and Sponsor will have no obligation to change or modify any of these Official Rules or take any further action as a result of such laws, decrees, regulations or guidelines of any Eligible Jurisdiction, except as is otherwise provided in these Official Rules.
Sponsor’s decisions are final and binding in all matters relating to this Contest, including, but not limited to, interpretation and application of these Official Rules. By entering the Contest, entrants fully and unconditionally agree to be bound by these rules and the decisions of the judges, which will be final and binding in all matters relating to the Contest. [In particular, it will be mandatory for each entrant to expressly accept these Official Rules and the grant of rights in favor of Sponsor with respect to entrant’s Submission pursuant to the terms indicated in these Official Rules. Additionally entrants must sign and return a written document as requested by Sponsor to perfect such grant, if necessary].
ALL JUDGING AND WINNER DETERMINATION WILL TAKE PLACE EXCLUSIVELY IN THE UNITED STATES OF AMERICA.
Gran\d Prize Winner: One (1) Grand Prize Winner will receive a DRL Pilot Contract opportunity valued at $50,000. The Grand Prize is contingent on the Grand Prize Winner successfully executing an agreement with DRL in the form provided by DRL, including a publicity release and exclusivity provision, and signing any and all other agreements, waivers, releases, and/or documents required by DRL in DRL’s sole discretion. If any potential Grand Prize Winner fails or refuses to sign and return all required documents within the prescribed time period following notification, the potential Grand Prize Winner may be disqualified and an alternate Grand Prize Winner may be selected.
In addition, Sponsor shall award the following prizes during the Contest Period based on Game Scores on the Leaderboard. In the event there is a tie between eligible entrants who have the same Game Score verified by Sponsor, the tie will be broken based on include tie-breaking mechanism – e.g., tied entrants must play each other in a single-elimination Tournament Game on a date determined by Sponsor to break the tie.

Sponsor will also award the following add-on prizes:
Participation Award: All entrants who have participated in six (6) or more Races by March 25th, 2020 will be entered into a random drawing. Sponsor or its representative will randomly select three (3) winners on or about March 26th, 2020 to receive a $250 prize.
Viewership Award: At the close of each of the twelve (12) Races, Sponsor will randomly select three (3) live stream viewers of that Race to receive a $100.
For the Participation Award and Viewership Award, odds of winning depend on the number of eligible entries received.
Total approximate retail value of all prizes combined: $74,250. Prizes are non-transferable. No substitutions or cash redemptions. Gift card terms and conditions may apply In the case of unavailability of any prize, Sponsor reserves the right to substitute a prize of equal or greater value. All federal, state, provincial and local taxes and unspecified expenses (including social contributions and/or VAT Taxes, where applicable) are the responsibility of winner(s). AWARDS OF PRIZES TO POTENTIAL WINNERS ARE SUBJECT TO THE EXPRESS REQUIREMENT THAT THEY SUBMIT TO SPONSOR ALL DOCUMENTATION REQUESTED BY SPONSOR TO PERMIT IT COMPLY WITH ALL APPLICABLE FEDERAL, STATE, PROVINCIAL, LOCAL OR OTHER TAX REPORTING LAW OR REGULATIONS IN THE UNITED STATES AND IN THEIR RESPECTIVE JURISDICTION. ALL PRIZES WILL BE NET OF ANY TAXES SPONSOR IS REQUIRED BY LAW TO WITHOLD. TO THE EXTENT PERMITTED BY LAW, ALL TAXES IMPOSED ON PRIZES ARE THE SOLE RESPONSIBILITY OF THE WINNERS. Refusal by any entrant to submit such documentation or complete any required forms or obligations shall result in such winner forfeiting the prize, leaving it unclaimed.
Value of prize awarded will be based on each winner’s country/jurisdiction of residency. The difference between the actual and the approximate ARV will not be awarded. Any cash prizes will be paid in U.S. currency or the local currency of the winner’s Eligible Jurisdiction, in Sponsor’s sole discretion. Entrants should be aware that to the extent any prize is to be awarded via check, such process of cashing in a winning check may result in deductions by clearing banks over which Sponsor has no control.
If due to a printing, production or other error, more prizes are claimed than are intended to be awarded, the intended prize will be awarded in a random drawing from among all verified and validated prize claims received. No more than the stated number of prizes will be awarded.
Potential winner(s) will be required to email Sponsor within five (5) calendar days in order to claim their prize. FOR RESIDENTES OF BRASIL: Winners will be required to sign and return a Receipt of Delivery of the prize. If the prize is not claimed by the winner in a one hundred and eighty (180) day-term as from the date of the Selection Date, the right of the respective owner will lapse and the correspondent amount will be collected by the Sponsor to the Brazilian National Treasury as Union Revenue within the following ten (10) days, in accordance with Article 6th of the Decree No. 70,951/1972.
If any potential winner cannot be contacted within five (5) calendar days of first notification attempt, if any prize or prize notification is returned as undeliverable, if any winner rejects his/her prize or in the event of noncompliance with these Contest rules and requirements, or any other laws, rules or regulations of any applicable jurisdiction by the winner, such prize will be forfeited and may be awarded to the Submission with the next highest score. Upon prize forfeiture, no compensation will be given.
Where applicable, Pilots must use the official email address in order to communicate with appropriate Sponsor representatives. This email address is tryouts@thedroneracingleague.com. Sponsor shall not be responsible for any failed attempts to contact Sponsor via any other channels or means. Sponsor does not guarantee a return response for Pilot communication and Sponsor expressly reserves rights to refuse same.
ALL POTENTIALLY WINNING ENTRANTS MUST BE VERIFIED BY SPONSOR TO ENSURE ELIGIBILITY PRIOR TO BEING DECLARED A WINNER AND/OR RECEIVING ANY PRIZE.
(a) Hacking: defined as any unauthorized modification to the DRL SIMULATOR by an outside third party;
(b) Game glitching: defined as “intentionally utilizing an internal game bug which was not intended for the purpose of gaining an unfair advantage;”
(c) impersonation: defined as “playing under another Pilot’s account or soliciting, inducing, encouraging or directing another person to play under another Pilot’s account;”
(d) collusion: defined as “two or more Pilots agreeing to affect the result of the competition and/or opposing Pilots”
(e) abusing in-game mechanics: defined as “any other activities similar to hacking, game glitching, impersonation, or collusion that, in DRL’s sole discretion, leverages an unfair advantage to the Pilot in a way that violates the spirit of fair play.”
Further, entrants shall not bet or gamble on the results of the Contest or engage in any activities constituting betting, gambling, bribery or gift taking in connection with the Contest. Entrants must conduct themselves in a sportsmanlike manner, maintaining a friendly and polite demeanor to competitors and to other participants of the Contest. Entrants who engage in unsportsmanlike, disruptive, annoying, harassing or threatening conduct or violate any rule, gain unfair advantage in participating in the Contest, or obtain winner status using fraudulent means, in Sponsor’s sole discretion, will be disqualified and removed from the Tournament Game. Entrants who violate any terms of use for the Site or any Contest platforms may be disqualified in Sponsor’s sole discretion. Sponsor will interpret these Official Rules and resolve any disputes and the Sponsor’s decisions shall be final with respect to any disputes.
CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
This promotion is governed by U.S. law and is subject to all applicable federal, state and local laws and regulations. Void where prohibited by law. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant and Sponsor in connection with this Tournament, shall be governed by, and construed in accordance with, the laws of the State of New York without giving effect to the conflict of laws rules thereof, and any matters or proceedings which are not subject to arbitration shall take place in the courts of the State of New York, in the City of New York, County of New York.
If one or more provisions of these Official Rules shall be found invalid, illegal or unenforceable, the validity, legality and enforceability of the remaining provisions of these Official Rules shall not be affected in any way thereby. IN THE EVENT THERE IS A DISCREPANCY OR INCONSISTENCY BETWEEN DISCLOSURES OR OTHER STATEMENTS CONTAINED IN ANY TOURNAMENT MATERIALS AND THE TERMS AND CONDITIONS OF THE OFFICIAL RULES, THE OFFICIAL RULES SHALL PREVAIL, GOVERN AND CONTROL.
